Medical Malpractice
Medical malpractice is an act or omission by a health care provider which deviates from accepted standards of practice in the medical community and which causes injury to the patient. Simply put, medical malpractice is professional negligence by a healthcare provider that causes an injury.
Every year thousands of patients are seriously affected by medical errors. Whether an injury – or even death – results from an incorrect diagnosis, hospital negligence or a prescription miscalculation as examples, the consequences can be devastating to the patient as well as the family of the affected individual.
It is safe to say that medical malpractice claims are some of the most difficult and expensive to present. It is not unusual for an injured party to spend in excess of $100,000 to present their claim. Hiring medical experts/doctors who generally travel from out of town or out of state is just one example of the high costs associated with proving a malpractice claim. In addition, proving a claim can be complex and time consuming. Simply because a doctor does not perform perfectly does not mean an injured party has a claim; instead it must be proven that the doctor “fell below the appropriate standard of care.”
