“How about another round of drinks?” Sounds like good service from a waiter or bartender. But if a bar or social host serves too much alcohol to a visibly intoxicated person or minor who subsequently causes death or injury to a third-party as a result of an alcohol-related car crash and other accident, that bar or social host may be found liable. Liquor liability law quickly becomes complicated. There are different standards depending upon if the injury occurs in the property of the server versus off the property. Was the drinker “visibly intoxicated” and continued to be served by the bar/host? It is almost always necessary to hire a toxicologist or pharmacologist to give an expert opinion on the effects of alcohol as they relate to your case.
Also, because alcohol-related accidents can cause such serious injuries – or even death – bars and hosts may not have the insurance to cover these losses. Searching for a bar’s assets to cover a claim may become the most important part of a case. These cases can be long and difficult and generally involve many defendants including employees, owners, and witnesses (some of whom may have been intoxicated and unable to accurately recall facts.)
